Welcome to Klyp. These Terms of Service ("Terms") govern your access to and use of the Klyp platform, website, applications, and related services (collectively, the "Service").
By creating an account or using the Service, you agree to these Terms. If you do not agree with these Terms, you must not use the Service.

3. Description of the Service
Klyp is a web platform that allows users to create a public profile page accessible via a personalized URL. Users may add and arrange interactive blocks ("cards"), customize their page appearance, share content, and access analytics.
Available card types include links, text, social profiles, profile cards, countdowns, polls, guestbooks, audio players, video players, galleries, maps, and file downloads. Some card types and customization options are only available with the Pro plan.
The Service also includes a public discovery page ("Explore") and a template library. Each card may be individually protected by a password or scheduled with activation and expiration dates. You may opt out of appearing on the Explore page at any time in your settings.
The Service may evolve over time and features may be added, modified, or removed at any time.
4. Eligibility
You must be at least 16 years old to create an account or use the Service. By using the Service, you confirm that you meet this requirement.
If you are a parent or legal guardian and become aware that a person below this age has created an account, please contact us at support@klyp.it and we will remove the account and associated data.
5. User Accounts
To access certain features, you may need to create an account. You agree to:
- Provide accurate and current information;
- Use the authentication methods provided by the Service securely;
- Keep your credentials confidential;
- Be responsible for all activity under your account.
You must notify us promptly of any suspected unauthorized access to your account.
6. Usernames and Public Profiles
Usernames are subject to availability and assigned on a first-come, first-served basis. You may not:
- Use usernames that impersonate another person, brand, or company;
- Use offensive, illegal, or misleading usernames;
- Attempt to sell, trade, or transfer usernames without authorization;
- Reserve usernames you do not actively use.
Public profiles and the content displayed on them may be visible to anyone on the internet, may be indexed by search engines unless you enable the noindex option, and may appear on the Explore page unless you opt out.
7. User Content
You retain ownership of the content you upload or publish through the Service ("User Content"). By submitting User Content, you grant Klyp a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute that content solely for the purpose of operating, providing, and improving the Service.
You represent and warrant that you own or have the necessary rights, licenses, and permissions to share the User Content, including the right to use any image, audio recording, video, or file you upload, and the right to depict any identifiable person featured in your content.
You agree not to upload or share content that:
- Is illegal, fraudulent, or violates any applicable law;
- Infringes the intellectual property, privacy, image, or other rights of any third party;
- Contains malware, viruses, or harmful code;
- Is defamatory, abusive, hateful, harassing, or threatening;
- Contains sexually explicit material, child sexual abuse material, or graphic violence;
- Promotes discrimination, terrorism, or self-harm.
Klyp reserves the right to remove content or suspend accounts as described in section 12 (Content Moderation and Reporting) and section 15 (Account Suspension and Termination).
8. Visitor Interactions
Some card types allow visitors of your public page to interact with your content, including:
- Guestbook: visitors may leave public written messages on your page;
- Polls: visitors may cast votes that contribute to publicly displayed results;
- File downloads: visitors may download files you have uploaded.
As the page owner, you are responsible for moderating the visitor content displayed on your page and for the files you make available for download. Klyp may collect limited technical data from visitors (such as IP address) for security, abuse prevention, and to limit duplicate votes, as described in our Privacy Policy.
Visitor-submitted content is published under your responsibility. Klyp may remove such content if it violates these Terms or applicable law.
9. Payments and Pro Plan
Klyp offers a paid "Pro" plan that unlocks certain features (advanced card types, custom background images, removal of the "Made with Klyp" footer link). The Pro plan is sold as a one-time purchase that grants access to Pro features for a fixed period of 12 months from the date of payment confirmation.
Klyp does not use automatic recurring billing or subscriptions. No further amount will be charged after the initial purchase. Once your 12-month access period ends, your account automatically reverts to the free tier. To continue using Pro features, you must complete a new one-time purchase.
Payments are processed by third-party payment providers (currently Stripe). Detailed sales conditions, including pricing, refund policy, and the right of withdrawal, are set out in our Terms of Sale & Refunds.
10. Analytics
Klyp provides analytics related to profile visits, interactions, clicks, and visitor activity. You acknowledge that analytics figures are estimates, may rely on aggregated or anonymized data, and may not always be fully accurate.
11. Acceptable Use
You agree not to:
- Use the Service for unlawful, harmful, or fraudulent purposes;
- Attempt unauthorized access to systems, accounts, or data;
- Interfere with or disrupt the operation, integrity, or security of the Service;
- Circumvent any limitation, paywall, or access control;
- Scrape, crawl, copy, mirror, or otherwise extract data from the Service without explicit authorization;
- Use automated systems, bots, or scripts to abuse the Service or inflate analytics;
- Use the Service to distribute spam, malware, or unsolicited communications;
- Use the Service in a way that imposes an unreasonable load on our infrastructure.
12. Content Moderation and Reporting
Klyp reviews reports of illegal or policy-violating content. To report content you believe is illegal or breaches these Terms, please send an email to support@klyp.it including:
- The URL of the page or content concerned;
- A description of the issue and the legal or contractual basis of your report;
- Your contact information;
- A statement made in good faith that the information in the notice is accurate.
When Klyp restricts, removes, or otherwise acts on content or an account based on a report or our own review, we will, where required by applicable law (including the EU Digital Services Act), inform the affected user of the decision and the reasons for it, and provide information on how to challenge the decision by replying to the notification email.
13. Copyright Infringement Notices
If you believe that content hosted on the Service infringes your copyright, you may send a notice to support@klyp.it including:
- Identification of the copyrighted work claimed to be infringed;
- The URL of the allegedly infringing content on Klyp;
- Your contact information;
- A statement that you have a good-faith belief that the use is not authorized;
- A statement, under penalty of perjury where applicable, that the information is accurate and that you are the rights holder or authorized to act on their behalf.
Klyp may, at its discretion, remove or disable access to content that is the subject of a valid notice and may terminate accounts of repeat infringers.
14. Intellectual Property
The Klyp platform, branding, name, logos, interface, design, templates, and software are the property of the operator and are protected by intellectual property laws. You may not reproduce, distribute, modify, or reverse engineer any part of the Service without prior written permission.
The right to remove the "Made with Klyp" footer (available with the Pro plan) is granted as a non-transferable license for the duration of your Pro access period only and does not transfer any rights in the Klyp brand to you.
15. Account Suspension and Termination
Klyp may, at its sole discretion, suspend, restrict, or terminate accounts at any time if:
- These Terms are violated;
- Illegal or fraudulent activity is suspected;
- The Service or its users are placed at risk;
- Required by applicable law or competent authority.
You may stop using the Service or delete your account at any time from your dashboard. Deleting your account removes your public page and associated personal data, subject to the retention periods described in the Privacy Policy.
16. Disclaimer of Warranties
The Service is provided "as is" and "as available." To the maximum extent permitted by applicable law, Klyp does not guarantee:
- Continuous, error-free, or uninterrupted availability;
- That the Service will always be secure or free of bugs;
- That any specific feature, including third-party integrations, will remain available.
Mandatory consumer warranties under applicable law remain unaffected.
17. Limitation of Liability
To the maximum extent permitted by law, Klyp and its operator shall not be liable for:
- Indirect or consequential damages;
- Loss of profits, revenue, goodwill, data, or business opportunities;
- Business or operational interruption;
- User Content or visitor-submitted content.
Nothing in these Terms limits liability that cannot be excluded under applicable law, such as liability for intentional misconduct or gross negligence.
Your use of the Service is at your own risk.
18. Third-Party Services
The Service may integrate with or link to third-party platforms and services, including payment providers, hosting providers, email providers, and authentication providers. Klyp is not responsible for the content, policies, or practices of third-party services or websites.
19. Privacy
Your use of the Service is also governed by the Privacy Policy, which forms an integral part of these Terms and describes how we collect and process personal data.
20. Changes to the Terms of Service
Klyp may update these Terms at any time. Material changes will be communicated by email or through a notice on the Service. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Service.
21. Governing Law and Disputes
These Terms are governed by the laws of Switzerland, without regard to its conflict of law rules. Any disputes shall be subject to the competent courts of Switzerland.
If you are a consumer residing in the European Union, you may also rely on the mandatory consumer protection provisions of your country of residence. You may access the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/.

3. Information We Collect
Klyp may collect the following categories of information.

Profile Information
- Profile picture, display name, biography;
- Links, text content, social profiles;
- Uploaded media, gallery images, audio, video, downloadable files;
- Page customization (colors, fonts, background, layout, card configuration).
Technical Information
- IP address;
- Browser and device information;
- Operating system;
- Log data (timestamps, requested URLs, error events);
- Strictly necessary cookies (see section 7).
Usage and Analytics Information
- Page visits and click counts;
- Aggregated interaction data;

Visitor Information
When a third party visits a Klyp public page and interacts with certain cards, we may collect:
- IP address and basic technical metadata, used for security and to prevent abuse or duplicate poll votes;
- Text submitted to guestbook cards (which becomes public on the page owner's profile);
- Vote choices for polls (aggregated for display).
Payment Information
Payments are processed by Stripe. Klyp receives confirmation of payment, the purchase reference, and limited billing information necessary for invoicing and tax purposes. Klyp does not store full payment card details; these are handled directly by Stripe.
4. How We Use Information and Legal Bases
We process personal data for the following purposes, on the following legal bases under the GDPR and the Swiss FADP:
- Provide and operate the Service (account creation, hosting your page, authentication): performance of a contract (Art. 6(1)(b) GDPR);
- Display public profiles and visitor interactions: performance of a contract and legitimate interests (Art. 6(1)(b) and (f));
- Process payments and issue invoices: performance of a contract and legal obligation (Art. 6(1)(b) and (c));
- Provide analytics to page owners: performance of a contract (Art. 6(1)(b));
- Prevent abuse, fraud, and ensure security (rate limiting, spam prevention, vote integrity): legitimate interests (Art. 6(1)(f));
- Improve and develop the Service: legitimate interests (Art. 6(1)(f));
- Communicate transactional information (account notifications, security alerts, billing): performance of a contract (Art. 6(1)(b));
- Comply with legal obligations (tax, accounting, lawful requests): legal obligation (Art. 6(1)(c)).
5. Public Content and the Explore Page
Information you publish on your Klyp profile (username, profile picture, biography, links, uploaded media, guestbook entries) is publicly accessible on the internet by design.
Profiles are listed by default on the public Explore page. You may opt out of the Explore page at any time in your account settings. You may also enable a noindex setting to request that search engines do not index your page.
You are responsible for the information you choose to make public.
6. Cookies
Klyp uses only strictly necessary cookies required for the Service to function:
- Authentication cookies (to keep you logged in);
- Session and security cookies (CSRF protection, session management);
- Preference cookies (such as selected language or theme).
For audience measurement, Klyp uses Cloudflare Web Analytics, a privacy-friendly analytics service that does not use cookies or fingerprinting and does not track visitors across sites. For this reason, Klyp does not display a cookie consent banner under EU ePrivacy rules.
You may disable cookies in your browser settings, but the Service may not function correctly without them.
7. Data Sharing and Sub-processors
Klyp shares personal data with the following sub-processors, strictly to the extent necessary to operate the Service:
- OctoGency SARL (France) - application hosting;
- Stripe, Inc. (United States and Ireland) - payment processing for one-time purchases;
- Infomaniak Network SA (Switzerland) - transactional and notification emails;
- Cloudflare, Inc. (United States) - backup storage, content delivery, internal analytics, and abuse prevention;
- Public authorities, where required by law or by a binding order from a competent authority.
Each sub-processor processes personal data only for the specific purpose listed above, under its own data protection commitments and a data processing agreement where applicable.
Klyp does not sell personal data.
8. International Data Transfers
Some of our sub-processors are located outside Switzerland and the European Economic Area, in particular in the United States (Stripe, Cloudflare). When personal data is transferred to such countries, Klyp relies on appropriate safeguards, which may include:
- The EU Standard Contractual Clauses (SCCs) and the Swiss equivalent;
- The EU-U.S. Data Privacy Framework and the Swiss-U.S. Data Privacy Framework, where the recipient is certified;
- Other safeguards recognized by applicable data protection law.

9. Data Retention
Klyp retains personal data only as long as necessary for the purposes described in this Policy. Indicative retention periods:
- Active accounts: for as long as your account remains active;
- Inactive accounts (no login or page activity): up to 24 months, after which the account may be deleted following a prior notification;
- Deleted accounts and content: removed from production within 30 days; copies may persist in encrypted backups for up to 30 additional days;
- Technical logs: up to 12 months;
- Billing and accounting records: 10 years, as required by Swiss accounting law;
- Guestbook and poll data: retained for as long as the page or the card exists, then removed when the page owner deletes them or upon account deletion.
10. Security
Klyp implements technical and organizational measures to protect personal data, including:
- Encryption of traffic in transit using TLS;
- Strong password hashing using industry-standard algorithms;
- Restricted administrative access on a need-to-know basis;
- Regular software updates and security patches;
- Encrypted backups.
However, no online platform can guarantee absolute security. You are responsible for using a strong password and keeping your credentials confidential.
11. Data Breach Notification
If a personal data breach is likely to result in a risk to your rights and freedoms, Klyp will notify the competent supervisory authority within 72 hours of becoming aware of the breach, in accordance with applicable law. Where the breach is likely to result in a high risk, affected users will also be informed without undue delay.
12. Your Rights
Depending on your jurisdiction, you have the following rights regarding your personal data:
- Right of access to your data;
- Right to rectification of inaccurate or incomplete data;
- Right to erasure ("right to be forgotten");
- Right to restrict or object to processing;
- Right to data portability;
- Right to withdraw consent, where processing is based on consent;
- Right not to be subject to a decision based solely on automated processing.
To exercise these rights, send a request to support@klyp.it. We will respond within one month, with a possible extension of two additional months for complex requests.
13. Right to Lodge a Complaint
If you believe that our processing of your personal data infringes applicable data protection law, you have the right to lodge a complaint with a supervisory authority, in particular:
- In Switzerland: the Federal Data Protection and Information Commissioner (FDPIC) - www.edoeb.admin.ch;
- In the European Union: the data protection authority of your country of residence (for example, the CNIL in France, the AEPD in Spain, the Garante in Italy, the BfDI in Germany).
14. Children's Privacy
The Service is not intended for, and is not directed at, children under 16 years old. Klyp does not knowingly collect personal data from children below this age. If we become aware that personal data of a child below this age has been collected, we will delete it without undue delay. Parents or legal guardians who believe their child has provided personal data may contact support@klyp.it.
15. Automated Decision-Making
Klyp does not subject users to decisions based solely on automated processing, including profiling, that produce legal or similarly significant effects.
16. Changes to this Privacy Policy
Klyp may update this Privacy Policy at any time. Material changes will be communicated by email or through a notice on the Service. These Terms of Sale & Refunds govern purchases of paid services through Klyp. They complement the Terms of Service and the Privacy Policy.
By purchasing a paid service through Klyp, you agree to these Terms of Sale.

3. The Pro Plan
The Pro plan is the only paid offering on Klyp. It is sold as a one-time purchase that grants access to Pro features for a fixed period of 12 months from the date of payment confirmation.
Klyp does not use automatic recurring billing. No further amount will be charged after the initial purchase. To continue using Pro features beyond the 12-month period, you must complete a new one-time purchase at the price then in effect.
Pro features include the advanced card types (audio, video, gallery, map, file download), custom background images, and the option to hide the "Made with Klyp" footer. The exact list of Pro features may evolve over time.
4. Pricing and Currency
Prices are displayed at checkout and may be shown in different currencies depending on your location. The price applicable to your purchase is the one displayed at the moment you confirm the order. Klyp may change prices at any time; changes do not affect purchases already completed.
Where applicable, prices are shown inclusive or exclusive of taxes (such as VAT) as indicated at checkout. You are responsible for any local taxes, duties, or fees applicable in your jurisdiction.
5. Payments
Payments are processed by Stripe. By completing a purchase, you agree to provide valid and authorized payment information. Klyp does not receive or store full payment card details.
If a payment fails or is reversed after access has been granted, Klyp may suspend or revoke access to Pro features.
6. Right of Withdrawal (EU Consumers)
If you are a consumer residing in the European Union, you generally have a 14-day right of withdrawal for distance contracts, in accordance with Directive 2011/83/EU.
Because the Pro plan grants immediate access to digital content and digital services upon purchase, you are asked at checkout to:
- Expressly request that performance begin immediately during the withdrawal period;
- Acknowledge that, as a result, you lose your right of withdrawal once performance has begun (Art. 16(m) of Directive 2011/83/EU).
If you do not provide this consent at checkout, your purchase cannot be completed.
7. Refund Policy
Because Klyp provides digital services with immediate access:
- Purchases are generally non-refundable;
- Refunds may be granted at Klyp's discretion in exceptional cases (for example, a technical issue that significantly prevents use of Pro features and that we are unable to resolve);
- Abuse of the refund system may result in account restrictions.
To request a refund, contact support@klyp.it with your order reference and a description of the issue.
Mandatory consumer rights under applicable law remain unaffected.
8. Chargebacks
Users agree to contact Klyp support before initiating a chargeback or payment dispute. Fraudulent or abusive chargebacks may result in:
- Suspension of services;
- Account termination;
- Restrictions on future purchases;
- Recovery of the disputed amount and related fees.
9. Service Availability
Klyp does not guarantee uninterrupted availability of paid services. Temporary outages, planned maintenance, or technical issues may occur. We will endeavour to minimize and announce extended interruptions.
10. Termination of Paid Services
Klyp may suspend or terminate Pro access if:
- The Terms of Service are violated;
- Fraudulent activity is suspected;
- Payment obligations are not met or are disputed in bad faith.
Termination for cause does not entitle you to a refund of any remaining portion of the 12-month access period.
11. Limitation of Liability
To the maximum extent permitted by law, Klyp and its operator shall not be liable for:
- Indirect or consequential damages;
- Loss of profits, revenue, goodwill, data, or business opportunities;
- Business or operational interruption;
- User Content or visitor-submitted content.
